1. Acceptance of Terms

By accessing or using DecisionMaker.Email ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

DecisionMaker.Email is a platform that helps you find verified executive-level email addresses for businesses.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose including spamming or harassment
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to send unsolicited bulk emails
• Scrape, resell, or redistribute email data obtained through the Service
• Bypass credit limits or abuse the free tier

5. Intellectual Property

All content, branding, and technology of DecisionMaker.Email are the property of DecisionMaker.Email. You may not copy, reproduce, or redistribute any part of the Service without prior written consent.

6. Payments, Credits & Refunds

DecisionMaker.Email operates on a credit-based system. Credits are consumed when a search returns at least one verified email address. If a search returns no verified results or fails due to a system error, the credit is automatically refunded to your team balance. Paid plans (Pro, Max) provide monthly credit allocations that do not roll over between billing periods. All payments are processed through Dodo Payments. You agree to provide accurate billing information. Purchased credits and subscription fees are non-refundable except where required by applicable law.

7. No Guarantee of Results or Accuracy

Results are provided on a best-effort basis. DecisionMaker.Email does not guarantee that:

• A search will return any results for a given domain or executive role
• Returned email addresses are accurate, current, or belong to the intended individual
• Email addresses marked as verified will remain valid over time or will not bounce
• The executive role, name, or title associated with a result is correct or up to date

You acknowledge that email addresses and personnel change frequently and that results may contain inaccuracies. You use all results at your own risk and discretion.

8. Your Responsibilities & Compliance

You are solely responsible for how you use email addresses obtained through the Service. You agree to comply with all applicable laws and regulations, including but not limited to:

• CAN-SPAM Act, GDPR, CASL, and other anti-spam and data protection laws
• Laws governing unsolicited commercial communications in your jurisdiction
• Any applicable industry-specific regulations regarding outreach and data use

DecisionMaker.Email is a research tool. We do not endorse or encourage unsolicited bulk emailing, spamming, or any form of harassment. We are not responsible for any consequences arising from your use of the data provided.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

In no event shall DecisionMaker.Email, its owners, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory.

To the maximum extent permitted by law, our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid to DecisionMaker.Email in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless DecisionMaker.Email, its owners, affiliates, and contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your use of email addresses or data obtained through the Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We encourage you to review this page periodically.
